2. Eligibility
You must be legally capable of entering into a binding contract to purchase products from our website.
If you are purchasing products on behalf of a business, organization or other entity, you represent that you have authority to bind that entity to these Terms & Conditions.
3. Products
We sell beekeeping equipment, hive components, honey, food products and other related products.
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, specifications and pricing are accurate. However, photographs are for illustration purposes and actual products may vary slightly in appearance, colour, packaging or configuration.
Natural products, including honey and beeswax, may vary in colour, flavour, texture and crystallization. Such variations are normal characteristics of natural bee products and do not necessarily indicate a defect.
Beekeeping equipment may also have minor variations resulting from manufacturing processes, wood characteristics, assembly or seasonal availability.
4. Product Availability
All products are subject to availability.
We reserve the right to limit quantities purchased by any customer and to discontinue products without notice.
If a product becomes unavailable after you place an order, we will contact you and may offer a replacement, delay shipment with your agreement, or provide a refund for the unavailable product.
5. Prices
All prices displayed on our website are in Canadian dollars (CAD) unless otherwise stated.
Applicable taxes, shipping charges and other charges will be displayed during checkout where applicable.
We reserve the right to change prices at any time. A price change will not affect an order that has already been accepted and confirmed, except where required or permitted by applicable law.
6. Orders and Order Acceptance
Submitting an order through our website constitutes an offer to purchase the products identified in the order.
After you submit an order, you will normally receive an order confirmation by email.
An order confirmation acknowledges receipt of your order but does not necessarily mean that the order has been accepted if circumstances require us to reject or cancel the order.
We reserve the right to refuse or cancel an order where:
-
a product is unavailable;
-
there is an obvious pricing or product-description error;
-
we reasonably suspect fraudulent or unauthorized activity;
-
the shipping information is incomplete or inaccurate;
-
the order exceeds reasonable quantity limits; or
-
cancellation is otherwise permitted by applicable law.
If we cancel an order after payment has been processed, we will refund the applicable amount.
7. Payment
Payment must be made using an accepted payment method available through Shopify checkout.
You authorize us and our payment processors to charge the payment method provided for the total amount of your order, including applicable taxes and shipping charges.
We do not store complete credit-card information on our own systems where payment processing is handled by third-party payment processors.
8. Shipping and Delivery
Shipping is governed by our Shipping Policy.
Estimated delivery dates are estimates only and are not guaranteed unless expressly stated otherwise.
We are not responsible for delays caused by circumstances beyond our reasonable control, including carrier delays, weather, road closures, strikes, labour disruptions, natural disasters, customs delays, or other events beyond our control.
Risk of loss and responsibility for the products will be determined in accordance with applicable law and the terms disclosed at the time of purchase.
9. Address Accuracy
Customers are responsible for providing a complete and accurate delivery address.
If an order is returned to us because an incorrect or incomplete address was supplied, additional shipping charges may apply before the order can be resent.
We are not responsible for additional costs resulting from inaccurate delivery information supplied by the customer, except where applicable law provides otherwise.
10. Food and Honey Products
Honey and other food products must be stored and handled in accordance with the instructions provided on the product packaging.
Honey is a natural food product and may crystallize. Crystallization is a natural characteristic of honey and is not, by itself, evidence that the honey is spoiled or defective.
Customers should follow all product-specific storage instructions.
Where applicable, products are labelled in accordance with applicable Canadian food and labelling requirements.
Nothing on our website should be interpreted as medical advice or as a claim that honey or another product can diagnose, treat, cure or prevent a disease unless such claim is legally permitted and expressly made in compliance with applicable law.
11. Beekeeping Equipment
Beekeeping equipment is intended for its ordinary beekeeping purpose and should be used by individuals who understand the appropriate equipment, safety procedures and risks associated with beekeeping.
Customers are responsible for using appropriate protective clothing and equipment and for following applicable safety instructions.
We are not responsible for injury, loss or damage resulting from misuse, improper assembly, modification, improper installation, failure to follow instructions, or use outside the intended purpose, except to the extent liability cannot legally be excluded or limited.
12. Natural Wood Products
Wood is a natural material. Hive bodies, frames, bottom boards, covers and other wooden equipment may contain natural variations such as knots, grain variations, colour differences, minor surface imperfections and dimensional variations within reasonable manufacturing tolerances.
These characteristics are not necessarily defects.
13. Intellectual Property

However, errors may occasionally occur, including typographical errors, pricing errors, product information errors or inventory errors.

18. Disclaimer
Except where expressly provided by law or by an applicable manufacturer's warranty, products are supplied subject to the warranties and conditions applicable under Canadian law.
Nothing in these Terms & Conditions excludes, restricts or limits a statutory warranty, consumer protection right, remedy or other right that cannot legally be excluded, restricted or limited.
19. Limitation of Liability
To the maximum extent permitted by applicable law, [Business Legal Name] will not be liable for indirect, incidental, special or consequential losses arising from the use of our website or products.
Nothing in these Terms & Conditions limits liability for matters that cannot legally be limited or excluded under applicable law.
20. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless [Business Legal Name], its owners, employees and agents from claims, losses, damages and expenses arising from your unlawful use of the website or misuse of products, except to the extent caused by our negligence, breach of contract or other conduct for which liability cannot legally be excluded.
21. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
22. Electronic Communications
When you place an order, create an account, submit a contact form or otherwise communicate with us electronically, you consent to receiving electronic communications relating to your transaction and account.
Electronic communications may include order confirmations, invoices, shipping notices, customer-service communications and other transactional messages.
Marketing communications will be handled in accordance with applicable anti-spam and privacy laws.
23. Consumer Protection Rights
Nothing in these Terms & Conditions is intended to waive, restrict or exclude rights or remedies that cannot legally be waived, restricted or excluded.
Ontario's Consumer Protection Act contains specific requirements for qualifying internet agreements, including prescribed disclosures, an opportunity to correct errors and delivery of a copy of the agreement.
24. Governing Law
These Terms & Conditions are governed by the laws of the Province of Ontario and the applicable laws of Canada.
Where permitted by law, disputes will be subject to the courts of Ontario.
25. Changes to These Terms
We may update these Terms & Conditions from time to time.
The version applicable to an order will generally be the version in effect when the order was placed, subject to applicable law.
26. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision will be interpreted or limited to the extent necessary, and the remaining provisions will continue in effect.
